Effective date: 9/29/2026
These Terms of Use are entered into between you and Heather Beardsley, LLC (the “Company,” “we,” “us,” or “our”). They govern your access to and use of https://hbeardsley.com (the “Website”), including its content, downloadable resources, digital products, courses, programs, communities, and services, unless a separate written agreement states otherwise.
Please read these Terms carefully. By using the Website or accepting these Terms at checkout or registration, you agree to them. If you do not agree, do not use the Website or purchase its products or services. The Website is intended for people age 18 or older who can enter into a binding agreement.
1. Privacy and Other Applicable Terms
Our Privacy Policy explains how we collect, use, and share personal information. Our Disclaimer provides additional information about the educational nature of our content. Please review both pages, accessible through the Website footer.
A particular product, program, or coaching service may have additional terms disclosed before purchase or provided in a separate agreement. If those terms conflict with these Terms, the specific terms govern that product or service. Nothing in these Terms limits rights or remedies that applicable law does not allow us to exclude.
2. Changes to These Terms
We may update these Terms from time to time and will identify the effective date of the revised version. Changes apply prospectively from that date. We will provide additional notice or obtain consent when required by applicable law.
The purchase-specific terms in effect when you place an order govern that purchase, unless you agree to a change or applicable law permits otherwise. Please review this page periodically.
3. Website Access and Account Security
We may update, suspend, or discontinue Website features or restrict access as reasonably necessary for maintenance, security, or enforcement of these Terms. We do not guarantee that the Website will always be available or error-free. This provision does not eliminate our obligations concerning purchases already made.
Provide accurate, current information when purchasing, registering, or using our services. Keep your login credentials confidential, and do not share access to your account, paid programs, or private communities. You are responsible for activity you authorize through your account. Notify us promptly if you suspect unauthorized access or a security breach.
4. Educational Content and Coaching
Our Website, planners, Field Guide, worksheets, courses, podcasts, programs, and coaching provide education and support related to habits, food, weight management, personal development, and follow-through.
They do not provide medical diagnosis or treatment, mental health treatment, individualized medical nutrition therapy, or legal, financial, or tax advice. Coaching does not establish a physician–patient, therapist–client, or other licensed healthcare relationship.
Consult an appropriately qualified professional about your individual circumstances, including medical conditions, symptoms, medications, dietary needs, or exercise limitations. Do not disregard professional advice or delay seeking care because of our content. Do not change prescribed treatment or medication based solely on our materials.
5. Personal Responsibility and Results
You decide whether and how to use our educational content and coaching. Your results depend on your circumstances, health, participation, actions, and other factors. We do not guarantee any specific amount of weight loss, change in body composition, health outcome, or other result.
Testimonials and examples reflect individual experiences. They do not promise that you will achieve the same results. We aim to provide accurate, useful information, but content may contain errors or become outdated. Contact us if you identify an error.
6. Intellectual Property
The Website and our products contain original writing, illustrations, graphics, recordings, and other protected content owned by the Company or used with permission. Applicable copyright, trademark, and other intellectual property laws protect that content. Product-specific copyright notices identify the relevant rights holder where applicable.
Purchasing or downloading a resource gives you the limited license described below; it does not transfer ownership of the underlying content. You may not remove copyright notices or use our names, logos, or trademarks in a way that suggests our sponsorship or approval without written permission.
Our restrictions concern protected content and unauthorized uses. They do not claim exclusive ownership of general ideas, facts, habits, methods, or concepts, or restrict uses permitted by applicable law.
7. Personal-Use License for Digital Products and Free Resources
Unless a product description or separate agreement expressly states otherwise, we grant you a limited, non-exclusive, non-transferable license to use purchased or downloaded materials for your individual personal use.
This includes the Follow Through Planner, the Follow Through Field Guide, seasonal planners, bundles and collections, worksheets, templates, handouts, recordings, and free downloadable resources.
For your own personal use, you may:
- Download and store your files on devices you own or control.
- Print pages or copies for yourself.
- Import compatible files into a note-taking or PDF annotation app.
- Complete worksheets, add notes, annotate pages, and duplicate working pages within your personal files.
- Retain a reasonable backup copy of downloaded files.
You may not, without our written permission:
- Share files, download links, login credentials, or copies with other people.
- Resell, sublicense, distribute, publicly upload, or give away the materials, including printed copies.
- Repackage our protected content into a product, course, membership, template, or other resource for others.
- Use our materials to teach, coach, train, or serve clients, or distribute them within a business, organization, or group.
- Publish modified versions of our protected content or present it as your own.
Buying a bundle does not provide a group or commercial license. If you would like to use our materials with clients, a class, or a group, contact us about written permission before doing so. These restrictions do not prevent personal completion and annotation or uses permitted by applicable law.
8. Digital Product Format, Delivery, and Compatibility
The product listing describes the files, resources, and access included in your purchase. A digital product does not include a physical printed item unless the listing expressly says so.
Digital download links are provided electronically after a successful purchase. Provide a working email address and check your spam or junk folder if your purchase email does not arrive. Contact us if you need help accessing an order.
You are responsible for having a compatible device, software, internet connection, and adequate storage. Any third-party app, printing, or related costs are your responsibility unless expressly included in the product listing. Features such as hyperlinks and annotation may function differently across apps and devices.
A dated planner covers the period stated in its listing. A purchase does not automatically include future editions, separate products, coaching, subscriptions, or later upgrades unless expressly included. Access duration and any download restrictions are those disclosed for the product at purchase. Download and back up your files promptly.
9. Prices, Payments, and Promotions
Prices and included features are those displayed at purchase. Applicable taxes and additional charges, if any, will be identified at checkout. You authorize the payment method you provide to be charged for your order and for any recurring payments to which you separately agree.
Discount codes are subject to the conditions disclosed with the offer. Unless an offer states otherwise, discounts apply to regular-price products and cannot be combined with sale prices or other discounts. A promotion does not apply retroactively unless expressly stated.
An installment payment plan is a commitment to pay the agreed total price, rather than a cancel-at-any-time subscription, unless its terms expressly say otherwise. The payment schedule and any cancellation terms will be disclosed before purchase.
10. Digital Product Refund Policy
Because digital products provide access to downloadable or electronic content, digital product purchases are final and non-refundable once access has been provided, except where applicable law requires otherwise or an express written guarantee applies to the purchase.
This policy includes planners, the Follow Through Field Guide, digital bundles, worksheets, and other digital downloads. A decision not to download, print, or use a product does not by itself create a refund entitlement after access is provided.
If a file is missing, corrupted, inaccessible, or different from what you ordered, contact us with your order details so we can investigate and provide an appropriate correction or remedy. This policy does not limit any rights you have under applicable consumer protection law.
11. Coaching Guarantee and Refund Requests
Unless the written terms of a particular coaching service provide otherwise, our coaching services include a 30-day money-back guarantee, subject to the conditions below. This coaching guarantee does not apply to standalone digital products or to the digital product portion of a bundle unless expressly stated in the offer.
To request a refund under the coaching guarantee, email us within 30 days of the purchase date. Include your name, purchase email address, service purchased, purchase date, and order number if available. Describe the steps you took to participate in and implement the coaching and why it did not meet your needs.
Any specific participation or documentation requirements must be disclosed in the coaching offer before purchase. We will assess your request against those disclosed requirements. The guarantee is available once per customer, unless a specific offer states otherwise or applicable law requires otherwise.
Approved refunds are returned through the applicable payment processor. Processing times depend on the processor and financial institution. A refund ends access to the refunded service and the license to use materials included with it. Stop using those materials and remove your downloaded copies, except records you are legally entitled or required to retain.
Services without an applicable guarantee are governed by their disclosed cancellation and refund terms, subject to applicable law.
12. Subscriptions and Cancellation
When a service is offered as an automatically renewing subscription, its price, billing frequency, renewal terms, and cancellation method will be disclosed before you enroll. Recurring charges require your consent. One-time digital product purchases do not automatically create a subscription.
You may cancel a subscription by emailing [email protected] with your name and purchase email address, or by using any cancellation option provided with your account or subscription. Cancellation stops future renewals. Unless the offer states otherwise, access continues through the paid subscription period, and cancellation does not create a prorated refund for that period, subject to an applicable guarantee or rights required by law.
Send your cancellation request before the next renewal date. If a renewal charge is processed after your timely cancellation request, contact us so we can correct it. Cancellation of a subscription does not cancel a separate installment payment obligation.
13. Community and Communication Standards
If you participate in a Company community, group, forum, comment area, or other communication space, treat others respectfully and follow any additional posted guidelines.
Do not harass or threaten others, post unlawful or infringing content, share another person’s private information without permission, upload harmful files, send spam, solicit members without permission, or interfere with the operation of the community. Do not record, reproduce, or distribute another participant’s contributions or private community discussions without permission.
We may moderate content and restrict or terminate access for violations. We do not guarantee that every post will be monitored. A group or community is not a confidential healthcare setting; share personal information with care. Other participants are responsible for their own statements, which do not necessarily represent our views.
14. Your Submissions, Feedback, and Testimonials
You retain ownership of content you submit, subject to any rights of others. You represent that you have permission to share it.
When you submit content to a community or Website feature, you grant us a non-exclusive license to host, display, and process it as reasonably necessary to operate that feature, subject to our Privacy Policy and applicable law.
Participation in coaching or a private community does not by itself authorize us to publish your private messages, identifying information, photographs, or personal results in marketing. We will obtain appropriate permission for those uses. Any separate testimonial, media, or guest appearance agreement governs the uses it specifically authorizes.
15. Electronic Communications
We may communicate electronically about purchases, accounts, services, and required notices. Where permitted by law, electronic communications satisfy requirements for written communications. Marketing emails are subject to our Privacy Policy and any applicable consent and unsubscribe requirements.
Email is not guaranteed to be secure. Sending an inquiry does not by itself establish a coaching relationship. A coaching relationship begins under the terms of the applicable service agreement.
16. Third-Party Services and Links
The Website may link to external websites or use third-party services for payments, email, file delivery, scheduling, communities, or other features. Those providers have their own terms and privacy practices. A link does not by itself constitute an endorsement.
We are not responsible for content or activities on websites we do not control. Our use and sharing of personal information are described in our Privacy Policy. A reference to an app or service does not guarantee its continuing availability or compatibility.
17. Prohibited Website Use
Do not use the Website unlawfully, attempt to bypass security or access controls, impersonate someone else, collect users’ personal information without permission, introduce malware, or interfere with the Website’s operation. Do not obtain paid content through unauthorized means.
18. Warranties and Limitation of Liability
Except for express promises made in a product description or service agreement, and to the extent permitted by law, the Website and educational materials are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free content, or any particular outcome. To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
To the extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential damages arising from use of the Website, products, or services.
Nothing in these Terms excludes liability or remedies that cannot legally be excluded, including liability for fraud, intentional misconduct, or other conduct for which applicable law prohibits limitation. Some jurisdictions do not permit certain warranty exclusions or liability limitations; those provisions apply only to the extent permitted in your jurisdiction.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Company and its personnel against third-party claims, damages, and reasonable expenses arising from your unlawful use of the Website, infringement of another person’s rights, or material violation of these Terms. This obligation does not apply to losses caused by the Company’s own misconduct or to obligations that applicable law does not permit us to impose.
We will notify you of a claim for which we seek indemnification and provide a reasonable opportunity to participate in its defense. No settlement may impose an obligation on you without your consent, which may not be unreasonably withheld.
20. Disputes and Governing Law
Please contact us first about a dispute so we can try to resolve it. Doing so does not waive your rights or extend a legal filing deadline unless we agree in writing.
Subject to applicable law, disputes arising from these Terms, the Website, or our products or services will be resolved through individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. Either party may bring an eligible individual claim in small claims court. Arbitration fees and costs will be allocated under the applicable rules and law; these Terms do not require a consumer to pay all arbitration costs.
Any hearing location or remote participation will be determined under the applicable consumer rules and law. Arbitration replaces a court trial for covered claims, and those claims are resolved individually rather than as a class proceeding, to the extent permitted by law. Nothing in this section prevents either party from reporting a matter to a government agency or exercising rights that cannot legally be waived.
Florida law governs these Terms, without overriding mandatory consumer protections that apply where you reside. If arbitration is unavailable or a dispute is not subject to arbitration, the appropriate court and venue will be determined under applicable law. A separate signed service agreement may provide different dispute terms for that service.
21. Termination
We may suspend or end access for material violations of these Terms, unlawful conduct, or security concerns. Where reasonably appropriate, we will provide notice and an opportunity to address the issue. Termination does not eliminate rights, remedies, payment obligations, or refunds required by applicable law or a specific service agreement.
Provisions that by their nature should continue after termination, including intellectual property restrictions and dispute provisions, continue to apply to the extent permitted by law.
22. General Terms
These Terms and applicable purchase or service agreements constitute the agreement concerning their subject matter. No partnership, employment, agency, or joint venture is created by using the Website or buying our products or services.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
Visitors outside the United States are responsible for complying with applicable local laws. Nothing in these Terms removes mandatory protections available to them under those laws.
